    Terms of Service

    The agreement that governs use of TruTalent — accounts, candidate and recruiter services, AI-assisted features, fees, acceptable use, liability, and governing law.

    Plain-language summary

    TruTalent is an AI-assisted talent intelligence and hiring platform. It can help candidates build verified professional profiles and receive career insights, and can help authorized recruiters and employers search, assess, communicate with, and manage candidates. TruTalent does not guarantee employment, candidate performance, salary outcomes, identity authenticity, or the accuracy of AI-generated or third-party information.

    1. Agreement and scope

    These Terms govern access to trutalent.ai, TruTalent applications, candidate and recruiter accounts, enterprise workspaces, APIs, assessments, verification workflows, communications, reports, integrations, and related services (the Service). By creating an account, submitting information, accepting an invitation, buying a plan, or using the Service, you agree to these Terms and the policies expressly incorporated into them.

    If you use the Service for an organization, you represent that you have authority to bind it. A signed order form, master services agreement, or data processing addendum prevails over these Terms to the extent of a direct conflict.

    2. Eligibility and account types

    The Service is intended for people aged 18 or older unless TruTalent has expressly enabled a verified parental or guardian-consent workflow. Candidate, recruiter, hiring-manager, administrator, partner, and enterprise accounts may have different permissions. You must provide accurate information, protect credentials, use multi-factor authentication where offered, and promptly report suspected compromise.

    3. Candidate services

    Candidate features may include profile creation, resume parsing, document or employment verification, skills analysis, salary or market-range insights, job discovery, applications, assessments, interview workflows, communications, and AI-assisted recommendations. Candidates control submissions subject to employer workflows, legal retention, fraud prevention, and contractual requirements. A verification indicator means only that TruTalent applied the stated process; it is not a guarantee and may be withdrawn or corrected.

    4. Recruiter and employer services

    Recruiters and employers may access candidate data only for legitimate recruitment, workforce planning, talent engagement, or related purposes disclosed to the candidate. They must not use the Service for unlawful discrimination, non-recruitment marketing, data brokerage, surveillance, scraping, identity theft, or decisions unrelated to the candidate's reasonable expectations.

    Employers remain responsible for job descriptions, eligibility criteria, interview conduct, employment decisions, notices, accommodations, anti-discrimination compliance, record retention, and the lawful use of candidate information.

    5. AI-assisted features and human responsibility

    TruTalent may use AI to parse resumes, normalize skills, recommend jobs or candidates, summarize interviews, estimate market ranges, detect inconsistencies, prioritize workflows, or generate explanations. AI outputs can be incomplete, inaccurate, biased, outdated, or unsuitable. TruTalent does not permit customers to use an AI score or recommendation as the sole basis for a final decision that materially affects a person without appropriate human review and lawful safeguards.

    The AI Usage, Output and Transparency Policy is the single source of detailed AI rules and is incorporated into these Terms.

    6. User content and permissions

    You retain rights in content you lawfully submit. You grant TruTalent a non-exclusive, worldwide, limited licence to host, copy, transform, analyze, transmit, display, and otherwise process that content to provide, secure, support, and improve the Service, comply with your instructions and applicable law, and enforce these Terms. You represent that you have the rights and lawful basis needed to submit the content.

    Do not upload passwords, private keys, full payment-card data, unrelated medical records, unnecessary government identifiers, or data you are not authorized to share. Verification documents may be subject to additional notices and restricted access.

    7. Platform and intellectual property

    TruTalent and its licensors own the Service, software, interfaces, workflows, taxonomies, models, prompts, scoring logic, reports, documentation, trademarks, and related intellectual property. Except for permitted use of your outputs, no rights are transferred. You must not reverse engineer, extract model logic, scrape, mirror, resell, bypass controls, or create a competing dataset from the Service.

    8. Output rights

    Subject to payment and these Terms, you may use outputs created for you for lawful internal recruitment, career, or workforce purposes. Outputs may not be unique and may contain third-party or public information. TruTalent does not guarantee copyright ownership, registrability, non-infringement, factual correctness, or fitness for a specific employment decision.

    9. Acceptable use

    You must comply with the Acceptable Use Policy. Prohibited conduct includes illegal activity, discriminatory hiring, deceptive job listings, impersonation, credential theft, unauthorized background checks, scraping, harassment, malware, evasion of access controls, and use of candidate data for unrelated advertising or sale.

    10. Third-party services

    The Service may integrate with identity, communications, cloud, analytics, assessment, background-verification, payment, calendar, applicant-tracking, or other providers. Third-party services may have their own terms. TruTalent is not responsible for third-party services except as expressly agreed or required by law.

    11. Fees, renewals and taxes

    Paid plans, usage limits, seats, credits, billing cycles, taxes, renewal terms, and cancellation rules are shown at checkout or in an order form. Unless the checkout or order form states otherwise, subscriptions renew automatically for the same period until cancelled before renewal. Fees are non-refundable except where law or a signed agreement requires otherwise.

    12. Suspension and termination

    TruTalent may restrict or suspend access to prevent security harm, investigate misuse, respond to law, address non-payment, or enforce these Terms. Where reasonably practicable, TruTalent will give notice and an opportunity to remedy. You may stop using the Service and request closure; retention and deletion follow the Privacy Notice and applicable customer agreement.

    13. Confidentiality

    Each party must protect non-public business, technical, candidate, and customer information received from the other and use it only for the agreed purpose. This obligation does not cover information that is public without breach, independently developed, lawfully received without restriction, or required to be disclosed by law after permitted notice.

    14. Disclaimers

    The Service is provided as is and as available to the maximum extent permitted by law. TruTalent disclaims implied warranties of merchantability, fitness, non-infringement, uninterrupted availability, hiring success, candidate quality, employment outcome, salary outcome, verification certainty, and AI accuracy. Nothing excludes mandatory consumer or statutory rights.

    15. Limitation of liability

    To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or loss of profit, revenue, goodwill, opportunity, or data. TruTalent's aggregate liability under these Terms will not exceed the fees paid or payable for the affected Service during the twelve months before the event giving rise to the claim, or INR 100,000, whichever is greater. This cap does not apply where liability cannot lawfully be limited, or to fraud, wilful misconduct, confidentiality breach, or infringement obligations expressly assumed in a signed agreement.

    16. Indemnity

    You will defend and indemnify TruTalent against third-party claims arising from your unlawful content, misuse of candidate data, discriminatory or illegal hiring conduct, breach of these Terms, or infringement of third-party rights. Enterprise agreements may allocate indemnities differently.

    17. Governing law and disputes

    These Terms are governed by Indian law. Courts in Bengaluru, Karnataka have exclusive jurisdiction, subject to mandatory law and any arbitration clause in a signed enterprise agreement. Before filing a claim, the parties will attempt good-faith resolution for 30 days through the contact addresses below.

    18. Changes and document hierarchy

    Material changes will be notified through the Service, email, or a prominent website notice. The hierarchy is: signed enterprise agreement or order form; DPA; SLA; these Terms; product-specific terms; Privacy Notice; AI Policy; Acceptable Use Policy; other public notices.
